A second German man has been convicted of gambling online through an illegal foreign site, receiving a hefty fine from the Munich District Court.
The unnamed player was playing blackjack on a UK betting website, and claimed that they did not know that it was illegal for them to bet on an offshore site. The Judge disagreed though, saying it was the players' responsibility to know such things. He handed down a hefty fine of €64,000 as well as 70 days wages.
The player has appealed the decision, and Pinsent mason Technology Law Expert Dr. Igor Barabash thinks that the punter may have a case. Commenting on the matter Dr. Barabash said, “Unfortunately, the court did not fully evaluate whether the unlawful gambling rules under the German Criminal Code comply with EU law."
"There is a clear anomaly between, for example, rules that allow a German person to visit a casino outside of Germany and those that prohibit the same casino games being played online within Germany."
