Gambling giant MGM Resorts is facing opposition in its attempt to seize the web domain Excalibur Poker.com.
The man fighting MGM over the website, Adam Majewski is claiming that his website does not infringe on any brand ownership or trademark belonging to MGM Resorts. Majewski also claims that his website is not offering gambling services and that he has owned the site for many years. He accuses MGM Resorts of trying to seize the site in order to move its online poker ambitions ahead.
MGM is claiming that any website utilizing the word "poker" while being tied to any of of its properties is infringing on the its trademarks. The company's properties include the Bellagio, Excalibur, Luxor, and Mandalay Bay, among others.
Majewski and the other named defendants in the MGM case have had a preliminary injunction put into place by courts. Majewski has filed a motion for dismissal, which will be heard once all the facts are brought in front of the court.
