After suffering a setback in litigation against a New South Wales levy on turnover, the Australian divisions of internet gambling groups Betfair and Sportsbet won the right to appeal Friday.
The two companies will continue to contest a decision that they pay 1.5% of turnover to racing authorities in NSW. Corporate bookmaker Sportsbet has argued the fee is discriminatory and protectionist for wagering giant Tabcorp.
Both Sportsbet and Betfair say they should pay a fee based on gross profit rather than turnover.
The High Court on Friday granted both firms leave to appeal the decision by the Federal Court late last year.
